1. Introduction
These Terms and Conditions (“Terms”) govern access to and use of the website neximmvisa.com (the “Website”) and the services offered by Neximm Immigration Pvt. Ltd. (“Neximm,” “we,” “us,” or “our”). By accessing or using the Website or availing of our services, you (“User,” “Client,” or “you”) agree to be bound by these Terms in their entirety.
2. What We Do
Neximm Immigration Pvt. Ltd. is a study abroad and immigration consultancy firm headquartered in Dehradun, Uttarakhand, India, and is a Regulated Canadian Immigration Consultant (“RCIC”) authorized to provide immigration advisory services in respect of Canada. We offer the following services, among others:
- Counselling services and assistance with course and institution selection
- Preparation and review of Statements of Purpose (“SOP”) and Letters of Recommendation (“LOR”)
- Visa application processing and submission support
- IELTS examination coaching and preparation
- Preparation of visa documentation and interview readiness support
- Guidance regarding scholarship opportunities
- Assistance in securing accommodation
- Pre-departure orientation
- Post-arrival support services
3. Who Can Use Our Services
The services are for students and applicants who are interested in studying abroad and/ or applying for immigration. Users must provide accurate, complete, and up-to-date information at all times. In the event that the User is a minor, the consent of a parent/legal guardian shall be obtained before the beginning of any service.
4. User Obligations
The Client represents and warrants that all information disclosed to Neximm is true, accurate, and complete in all respects, it being expressly understood that the successful rendition of services hereunder is predicated upon the reliability of such information. Neximm reserves the right to terminate the engagement immediately without any liability when fraudulent, forged or misleading representations or documentation is submitted. Users are solely responsible for observing the deadline set by the Universities, Embassies or Immigration authorities, and Neximm will not be held liable or responsible for any delay due to incorrect or incomplete information provided by the User.
5. Fees and Payment
Full fees for the services shall be communicated to the Client before commencement of the services to which it is applicable. Payments shall be made solely through the payment channels designated and approved by Neximm; payments made through unauthorized or informal channels shall not be recognized. No fee shall be deemed to have been paid in respect of any one service as of payment of the other service, unless such payment has been expressly agreed in writing. Neximm reserves the right to revise its fee structure at its sole discretion, from time to time.
6. Refunds
The refund amount depends on the services rendered and the status of the work when the refund application is made. In general, fees paid for consultation services shall not be refundable after services have been initiated. Where a refund is determined to be applicable, the same shall be processed within a reasonable period thereafter. The exact conditions for refunds shall be as defined in the Client’s particular service contract and shall prevail in cases of discrepancy with this clause.
7. No Guarantee of Outcome
Neximm shall guide and support the applicants in every aspect of the procedure but cannot and does not guarantee any visa, admission offer or any other favorable result (as it is entirely within the discretion of the relevant university, embassy or immigration authority). Neximm will not be liable for any rejection, delay or adverse action based on decisions made by such third parties or policy changes.
8. Third-Party Service Providers
In providing services to Clients, Neximm may refer or introduce Clients to banks, insurers or third-party agents. All engagement between the Client and such third parties and all consequences thereof shall be an engagement between the Client and the relevant third party, and Neximm shall be neither a party nor liable for any consequences.
9. Intellectual Property
The text, logos, graphics and other information displayed on the Website are the exclusive property of Neximm Immigration Pvt. Ltd. and are subject to protection under applicable intellectual property laws. No person shall reuse, copy, or redistribute such content without the prior written permission of Neximm. Use of Neximm’s materials for commercial purposes requires prior written consent.
10. Limitation of Liability
In no event shall Neximm be liable for any indirect, incidental, consequential, or special damages, including but not limited to loss of income or loss of opportunity, arising out of or in connection with its services. Where liability is established, Neximm’s aggregate liability shall be limited to the amount paid by the Client for the specific service giving rise to such liability.
11. Privacy
The collection, use, and handling of Client data is governed by our Privacy Policy, which forms an integral part of these Terms. Neximm collects only such information as is necessary for the delivery of its services and does not sell or trade Client information to third parties.
12. Amendments to These Terms
Neximm reserves the right to amend or update these Terms at any time, at its sole discretion, to reflect changes in its services or applicable law. Continued use of the Website or services following any such amendment shall constitute acceptance of the revised Terms. Users are advised to review this page periodically.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Dehradun, Uttarakhand.
